In these Terms and Conditions; ‘FMG 2007’ means the Fremantle Masters Games 2007. ‘Claim’ means and includes any action, suit, proceeding, claim, demand, damage, cost or expense however arising including but not limited to negligence. ’FMG 2007 Activities’ means performing or participating in any capacity in any authorised or recognised FMG 2007 sport, event or activity. ‘Rules’ means the rules, regulations and policies of the FMG 2007 and the Sport Body organising any FMG 2007 Activities in which I participate.

Fitness to Participate; I declare that I am medically and physically fit and able to participate in the FMG 2007 Activities. I will immediately notify FMG 2007 in writing of change to my medical condition, fitness or ability to participate. I understand and accept that FMG 2007 will continue to rely upon this declaration as evidence of my fitness and ability to participate.

Medical Treatment; I consent to receiving any medical treatment that FMG 2007 reasonably considers necessary or desirable for me during my participation in the FMG 2007 Activities. I also agree to reimburse FMG 2007 for any costs or expenses incurred in providing me with medical treatment.

Rules; I agree to abide by all rules and regulations issued by the FMG 2007, and will abide by all written and verbal instructions given from time to time by authorised FMG 2007 personnel. I agree that failure to comply with any rule may result in my disqualification from the FMG 2007. I will at all times participate in the FMG 2007 with fair play and sportsmanship.

Release and Indemnity; In consideration of FMG 2007 accepting my entry form and fee, I, to the extent permitted by law:

Release and will release FMG 2007, the City of Fremantle and all of its affiliated clubs, sponsors, agents and all of their officers, directors, shareholders and employees from all claims, actions, suits or demands of whatever nature arising out of or related in any way to my participation in the FMG 2007 including any injury (or death) sustained by a third party as a result, directly or indirectly, of their participation in the FMG 2007.

Indemnify and will keep indemnified FMG 2007, the City of Fremantle and all of its affiliated clubs, sponsors, agents and all of their officers, directors, shareholders and employees in respect of any Claim by any person arising as a result of or in connection with my participation in an FMG 2007 Activities.

Age Policy; I declare that I have attained the minimum age for any sport or class that I have entered or will enter by any qualification date that has been stipulated on the Games Entry Form, or, if no date is stipulated, by 31 December 2007.

Drug Policy; FMG 2007 condemns the use of substance for the purposes of performance enhancement, which is contrary to the ethics of sport and incompatible with the philosophy of Masters Sport. I understand I may be required to undertake random drug testing.

Close of Entries; The official closing date for entries is 5.00pm (WST) 7 September 2007. I am aware that some sports have a limit on the number of participants they can cater for and FMG 2007 reserves the right to accept entries in order of receipt, until the maximum number of entries is obtained. I also acknowledge if insufficient entries are obtained age groups may be combined or events cancelled.

Late Entry policy; Participant entries received after 5.00pm Monday 20 August 2007 will be deemed as Late Entries and thus incur the late entry fee of $20. Late Entries are not guaranteed an opportunity to participate in the Games and may be only accepted at the discretion of FMG 2007 and the relevant Sport Convenor.

Entry Fees; Entry fees are GST inclusive unless otherwise stated. Should FMG 2007 be charged fees by their financial institution as a result of a dishonored payment, FMG 2007 reserves the right to pass on fees to participants, who will be ineligible to participate in the Games until such fees are paid to FMG 2007.

Refund Policy; Refunds of registration and sports fee are made without question less a $15 administration fee plus an amount determined by the Organising Sports Body that are committed to various expenses for their voluntary efforts. Refunds will be made on receipt of a written request at FMG 2007 office on or before the official closing date of entries of 7 September 2007. Cancellations received after the 7 of September 2007 will not be eligible for a refund. Applications for a transfer of registration fees to a replacement participant may be made and submitted in writing by both participants. The replacement participant must complete both the Games Entry form and the Sport Entry form and will be registered as a new participant with the existing fee payment. Refunds will be issued within 30 days following the conclusion of the Games.

Sport and Personal Injury Insurance; The participants acknowledge and accept that NO Sport / Personal Injury Insurance is included in the Games Entry fee, and that it is the participants responsibility to obtain coverage by such a policy.

Right to Use Image; I acknowledge and consent to photographs and electronic images being taken of me during my participation in any FMG 2007 Activities. I acknowledge and agree that such photographs and electronic images are owned by FMG 2007 and that FMG 2007 may use the photographs for promotional or other purposes without my further consent being necessary. Further, I consent to FMG 2007 using my name, image, likeness and also my performance in the FMG 2007 Activities, at any time, by any form of media, to promote FMG 2007.

Medal Policy; Gold, silver and bronze medals will be awarded in all sport events and age groups subject to participants adhering to the rules of the sport. If there are equal placings, medals will be awarded as follows;

           Equal first place: 2 gold / 1 silver
           Equal third placing: 1 gold / 1 silver / 2 bronze
           Equal second place: 1 gold / 2 silver
           Equal first and third placing: 2 gold / 2 bronze

Privacy; I understand that the information I have provided to FMG 2007 is necessary for the objects of FMG 2007. I acknowledge and agree that the information will only be used for the objects of FMG 2007. I understand that I will be able to access the information by contacting FMG 2007.

Conformation of Entry; I have provided the information required on the entry form. I warrant that all information provided is true and correct. I acknowledge these Terms and Conditions cannot be amended. If I do amend it my entry to FMG 2007 will be null and void.

Acceptance of Terms and Conditions; I acknowledge I have read and accept the Terms and Conditions of the Registration Booklet and agree to be bound by them and to compensate the organisation for any loss sustained by it as a consequence of any breach of these Terms and Conditions. I confirm all details I have completed in the Registration Booklet are true and correct.
