Terms and Conditions

In these Terms and Conditions; ‘2009 FMG’ means the 2009 Fremantle Masters Games. ‘Claim’ means and includes any action, suit, proceeding, claim, demand, and damage, cost or expense however arising including but not limited to negligence. ’ 2009 FMG Activities’ means performing or participating in any capacity in any authorised or recognised 2009 FMG sport, event or activity. ‘Rules’ means the rules, regulations and policies of the 2009 FMG and the Sport Body organising any 2009 FMG Activities in which I participate.

Fitness to Participate; I declare that I am medically and physically fit and able to participate in the 2009 FMG Activities. I will immediately notify 2009 FMG in writing of change to my medical condition, fitness or ability to participate. I understand and accept that 2009 FMG will continue to rely upon this declaration as evidence of my fitness and ability to participate.

Medical Treatment; I consent to receiving any medical treatment that 2009 FMG reasonably considers necessary or desirable for me during my participation in the 2009 FMG Activities. I also agree to reimburse 2009 FMG for any costs or expenses incurred in providing me with medical treatment.

Rules; I agree to abide by all rules and regulations issued by the 2009 FMG, and will abide by all written and verbal instructions given from time to time by authorised 2009 FMG personnel. I agree that failure to comply with any rule may result in my disqualification from the 2009 FMG. I will at all times participate in the 2009 FMG with fair play and sportsmanship.

Release and Indemnity; In consideration of 2009 FMG accepting my entry form and fee, I, to the extent permitted by law:

• Release and will release 2009 FMG, the City of Fremantle and all of its affiliated clubs, sponsors, agents and all of their officers, directors, shareholders and employees from all claims, actions, suits or demands of whatever nature arising out of or related in any way to the my participation in the 2009 FMG including any injury (or death) sustained by a third party as a result, directly or indirectly, of their participation in the 2009 FMG.
• Indemnify and will keep indemnified 2009 FMG, the City of Fremantle and all of its affiliated clubs, sponsors, agents and all of their officers, directors, shareholders and employees in respect of any Claim by any person arising as a result of or in connection with my participation in an 2009 FMG Activities.

Age Policy; I declare that I have attained the minimum age for any sport or class that I have entered or will enter by any qualification date that has been stipulated on the Games Entry Form, or, if no date is stipulated, by 31 December 2009.

Drug Policy; 2009 FMG condemns the use of substances for the purposes of performance enhancement, which is contrary to the ethics of sport and incompatible with the philosophy of Masters Sport. I understand I may be required to undertake random drug testing.

Close of Entries; The official closing date for entries is 5.00pm (WST) 7 September 2009. I am aware that some sports have a limit on the number of participants they can cater for and 2009 FMG reserves the right to accept entries in order of receipt, until the maximum number of entries is obtained. I also acknowledge if insufficient entries are obtained age groups may be combined or events cancelled.

Late Entry policy; Participant entries received after 5.00pm Monday 20 August 2009 will be deemed as Late Entries and thus incur the late entry fee of $20. Late Entries are not guaranteed an opportunity to participate in the Games and may be only accepted at the discretion of 2009 FMG and the relevant Sport Convener.

Entry Fees; Entry fees are GST inclusive unless otherwise stated. Should 2009 FMG be charged fees by their financial institution as a result of a dishonored payment, 2009 FMG reserves the right to pass on fees to participants, who will be ineligible to participate in the Games until such fees are paid to 2009 FMG.

Refund Policy; Refunds of registration and sports fee are made without question less a $15 administration fee plus an amount determined by the Organising Sports Body that are committed to various expenses for their voluntary efforts. Refunds will be made on receipt of a written request at 2009 FMG office on or before the official closing date of entries of 7 September 2009. Cancellations received after the 7 of September 2009 will not be eligible for a refund. Applications for a transfer of registration fees to a replacement participant may be made and submitted in writing by both participants. The replacement participant must complete both the Games Entry form and the Sport Entry form and will be registered as a new participant with the existing fee payment. Refunds will be issued within 30 days following the conclusion of the Games.

Sport and Personal Injury Insurance; The participants acknowledge and accept that NO Sport / Personal Injury Insurance is included in the Games Entry fee, and that it is the participants’ responsibility to obtain coverage by such a policy.

Right to Use Image; I acknowledge and consent to photographs and electronic images being taken of me during my participation in any 2009 FMG Activities. I acknowledge and agree that such photographs and electronic images are owned by 2009 FMG and that 2009 FMG may use the photographs for promotional or other purposes without my further consent being necessary. Further, I consent to 2009 FMG using my name, image, likeness and also my performance in the 2009 FMG Activities, at any time, by any form of media, to promote 2009 FMG.

Medal Policy; Gold, silver and bronze medals will be awarded in all sport events and age groups subject to participants adhering to the rules of the sport. If there are equal placings, medals will be awarded as follows;

• Equal first place: 2 gold / 1 silver
• Equal third placing: 1 gold / 1 silver / 2 bronze
• Equal second place: 1 gold / 2 silver
• Equal first and third placing: 2 gold / 2 bronze

Privacy; I understand that the information I have provided to 2009 FMG is necessary for the objects of 2009 FMG. I acknowledge and agree that the information will only be used for the objects of 2009 FMG. I understand that I will be able to access the information by contacting 2009 FMG.

Conformation of Entry; I have provided the information required on the entry form. I warrant that all information provided is true and correct. I acknowledge these Terms and Conditions cannot be amended. If I do amend it my entry to 2009 FMG will be null and void.

Acceptance of Terms and Conditions; I acknowledge I have read and accept the Terms and Conditions of the Registration Booklet and agree to be bound by them and to compensate the organisation for any loss sustained by it as a consequence of any breach of these Terms and Conditions. I confirm all details I have completed in this Registration Booklet are true and correct.

Disclaimer; The City of Fremantle, officers, agents and members will not be responsible for any claims, costs, proceedings or damages whatsoever and however arising directly or indirectly out of or in connection with it’s participation in 2009 Fremantle Masters Games or the provision by the City of Fremantle.
